2026 Amendment Rules
New Chapter XI-B (Rules 106C-1 to 106C-14) now governs how Maharashtra co-operative housing societies register, admit members, raise funds, levy maintenance, hold AGMs, and recover dues. Every rule, form, and fee — explained plainly, with a live maintenance calculator and registration checklist.

Elect a chief promoter
Call a promoters' meeting. Pass a resolution electing one person as chief promoter and authorising them to apply on everyone's behalf.

Reserve the society name (Form Y-1)
Chief promoter submits Form Y-1 to Joint/Deputy/Assistant Registrar by hand, registered post or email. Registrar must respond within 30 days. Include up to 4 alternative names in order of preference.

Open a bank account
Once the Registrar grants name reservation, open a bank account in the proposed society's name. Get a bank certificate of the credit balance — this is required for the registration application.

Collect share capital & entrance fees
Every promoter pays minimum 5 shares + ₹500 entrance fee into the bank account. Obtain a bank certificate confirming the credit balance in the society's account.

File registration application within 2 months (Form Y-1)
Submit the full registration application in Marathi, Hindi or English within two months of name reservation being granted. Must be signed by the chief promoter.

Registrar issues certificate of registration
The Registrar reviews the application and, if satisfied, registers the society. The society then becomes a legal entity under the Maharashtra Co-operative Societies Act, 1960.

Recovering unpaid dues
Fast-track certificate procedure — dues recovered as land revenue arrears, no separate civil suit needed.
Issue written notice to defaulting member
Send dues notice by registered post, hand delivery or courier. Inform that an application under section 154B-29 will be filed if dues remain unpaid.
Pass resolution at managing committee & general body
Both the managing committee and general body must pass a resolution authorising the Secretary/Chairman/Treasurer to file the recovery application and initiate proceedings.
File Form Y-6 with Registrar — court fee ₹100
Submit Form Y-6 with certified account extract, resolution copies, notice copies and original treasury challan. Registrar registers within 15 days and serves notice on the opponent.
Registrar issues recovery certificate (Form Y-7)
After hearing both sides (target: within 3 months), the Registrar issues Form Y-7. Amount recovered as arrears of land revenue under Maharashtra Land Revenue Code, 1966. No separate execution application needed.

₹2,500 for up to 25 flats; ₹5,000 for 26–50; ₹7,500 for 51–250; ₹10,000 above 250. Backward-class and Lok Awas Yojana societies pay ₹50. Tenant ownership and other housing societies pay ₹5,000.

Membership — regular, associate & provisional
Entrance fee ₹500 + minimum 5 shares. Associate members (relatives) can vote with prior written consent. After a member's death, nominees apply via Form Y-4 (provisional) or Form Y-5 (family arrangement). Entrance fee: ₹500 per Rule 106C-4.

Education, training & nominations
₹10 per member per month contributed to the co-operative education and training fund. Federations pay ₹1,000 annually. Members must submit nomination forms during their lifetime. Nomination can be revoked anytime by submitting a new form.

Society funds — sinking, repair & more
Sinking fund: minimum 0.25% p.a. of construction cost per flat. Repair & maintenance: minimum 0.75% p.a. Major repair, election, welfare, education and corpus funds also prescribed. Borrowing limit: 10× paid-up capital + reserves (self-redevelopment: 10× land value).

Service charges split equally by flat count. Property tax by carpet area. Water charges by inlet/tap count. Lift charges equally among flats in that building only. Interest on defaults capped at 12% simple interest p.a. Non-occupancy = 10% of service charge.

AGM quorum: two-third of members or 20, whichever is less. Members may attend via video conferencing. Decisions by 51% majority. Redevelopment: 14-day notice, two-third quorum, Registrar representative present, video recorded. Developer selected by 51% vote.
