Education, training & nominations

Rules 106C-7 to 106C-9 establish mandatory co-operative education and training obligations for housing societies, and codify the nomination procedure for members.

Annual education & training — obligations (Rule 106C-7)

Every co-operative housing society, association of societies, or co-operative housing association notified by the State Government must organise annual education and training programmes for its members, officers, and employees through the State Federal Society or the State Apex Training Institute.

Failure to contribute to the co-operative education and training fund can result in recovery of the unpaid amount as arrears of land revenue under section 154B-6 of the Act.

Education & training fund contributions (Rule 106C-7(2))

  • Each co-operative housing society: ₹10 per member per month.
  • Each co-operative housing association or association of societies: ₹1,000 per year.
  • Contributions collected annually and used within the same financial year or the following year for training programmes.
  • Contributions paid to the notified State Federal Society or State Apex Training Institute.

Requirements for State Apex Training Institutes (Rule 106C-7(5))

To be notified by the State Government as an eligible training provider, an institute must have:

  • Registration under the Maharashtra Co-operative Societies Act or any other Act.
  • A state-wide operational area.
  • Provisions in its bye-laws specifically for providing co-operative education and training.
  • Adequate infrastructure for delivering training to societies.
  • Qualified teaching and non-teaching staff.
  • Adequate experience in co-operative education and training.

Nominations — procedure (Rule 106C-8)

Members and joint members of a co-operative housing society can nominate any person(s) for provisional membership after their death.

  • Nomination must be made on the prescribed form (as specified in the society's bye-laws).
  • The member must sign the nomination form during their lifetime and submit it to the society.
  • For joint members: each member submits a separate nomination covering their respective share.
  • A nomination can be revoked or varied at any time by submitting a new nomination form following the procedure in the society's bye-laws.

A nomination is not a will and does not confer ownership. It identifies who should receive the member's shares and flat interest temporarily, as a trustee, until the legal heirs establish their title.

Nomination register (Rule 106C-9)

The society must maintain a register under Rule 32 recording the name and address of every person nominated for provisional membership purposes, and any revocation or variation of such nominations.

Frequently asked

Mandatory. Rule 106C-7(2) says every co-operative housing society "shall contribute" ₹10 per member per month. It is not optional.
