Permission for Subletting / Leave and Licence

43. (a) A Member desirous of giving his flat on leave and licence basis or entrusting it to a caretaker shall give at least 8 days' advance notice in writing to the Secretary of the Society before doing so. No No-Objection Certificate from the Society shall be required for giving a flat on leave and licence. (b) The Member shall submit a copy of the leave and licence agreement executed with the licensee to the Society within 8 days of execution. (c) The Member shall also submit a copy of the leave and licence agreement to the local police station as required under applicable law. (d) The licensee or caretaker shall apply for Nominal Membership of the Society in the prescribed form within 8 days of taking occupation. (e) The Member shall be responsible for payment of all dues of the Society in respect of the flat, notwithstanding the giving of the flat on leave and licence. (f) The Society shall be entitled to charge non-occupancy charges from the Member at the rate fixed by the General Body, where the flat is occupied by a person who is not a member of the Member's family.
