Repairs and Maintenance to be Carried Out by the Society
(a) Subject to the provisions of the Act, the Rules and these Bye-laws, the Society shall, at its cost, maintain, repair, renew or replace the common areas, common facilities, common amenities, common services and all parts of the building which are not exclusively allotted to or intended for the exclusive use of any Member.
(b) Without prejudice to clause (i), the Society shall be responsible for the maintenance, repair, renewal or replacement of the following:—
(i) foundations, columns, beams, slabs, load-bearing walls, shear walls, retaining walls, structural members and all other structural components of the building;
(ii) roof slabs, terraces, terrace waterproofing, parapet walls, chajjas, canopies, sunshades and weather protection structures forming part of the building;
(iii) external walls, external plaster, external painting, external cladding, façade treatment and waterproof coating of the building;
(iv) staircases, lift lobbies, common passages, corridors, entrance lobbies, foyers and all other common circulation areas;
(v) lifts, elevators, escalators, lift machinery, lift shafts, machine rooms, control panels and all lift equipment;
(vi) compound walls, entrance gates, security cabins, internal roads, driveways, footpaths, kerbs, pavements, gardens, landscaped areas, children's play areas and all other common open spaces;
(vii) club house, gymnasium, community hall, swimming pool, recreation areas and other common amenities provided by the Society;
(viii) overhead water tanks, underground water tanks, sumps, borewells, pumps, pressure pumps, hydro-pneumatic systems, rainwater harvesting systems and all common water storage and supply installations;
(ix) all common water supply pipelines, rising mains, distribution pipelines, valves, pumps and fittings up to the point from where the exclusive internal pipeline serving an individual flat/unit commences;
(x) all common drainage lines, soil stacks, waste stacks, vent pipes, rainwater down-take pipes, manholes, chambers, sewer lines, septic tanks, sewage treatment plants and storm-water drainage systems up to the point where the exclusive connection of an individual flat/unit commences;
(xi) the main electrical supply system including transformer, HT/LT panels, meter room, common distribution boards, electrical risers, common wiring, earthing system, lightning protection system, generators, solar power systems, inverters and all electrical installations up to the common supply point of each flat/unit;
(xii) fire prevention, fire detection, fire alarm, fire-fighting, sprinkler, hydrant, smoke extraction, emergency lighting and all other statutory fire safety systems;
(xiii) intercom systems, CCTV systems, access control systems, boom barriers, video door phones, security systems and all other common electronic installations provided by the Society;
(xiv) common ducts, service shafts, utility shafts, pipe shafts, electrical shafts and all common service installations passing through them;
(xv) expansion joints, seismic joints, settlement joints and all structural movement joints of the building;
(xvi) waterproofing of terraces, podiums, refuge areas and other common portions of the building;
(xvii) all common parking areas, visitor parking areas, parking decks and mechanical parking systems, excluding individual parking equipment installed by a Member;
(xviii) common refuse collection areas, garbage rooms, composting units and waste management systems;
(xix) all common facilities, common amenities and common services vested in or belonging to the Society under the Act, the Rules and these Bye-laws;
(xx) such other parts of the building or property as are not specifically made the responsibility of an individual Member under these Bye-laws.
(c) Where any repair involves both the Society's property and the internal portion of a flat/unit, the responsibility shall be determined in accordance with these Bye-laws after inspection by the Society, and where necessary, on the opinion of an Architect, Structural Engineer or other technical expert.
(d) The Society shall carry out routine maintenance, preventive maintenance and necessary repairs within a reasonable time after receiving information or becoming aware of the need for such repairs.
(e) The Society shall maintain proper records of inspections, technical reports, repairs, replacements and expenditure incurred in respect of the Society's property and common services.
(f) Nothing contained in this Bye-law shall relieve a Member from carrying out repairs and maintenance for which the Member is responsible under these Bye-laws.
