Bye-law 46Ch.9 · Maintenance, Repairs, Alterations and Occupation of Flats

Repairs and Maintenance to be Carried Out by Members

(a) Every Member shall, at his own cost, maintain, repair, renew and replace all parts of the flat/unit, fixtures, fittings, installations and appurtenances which are exclusively serving or intended for the exclusive use of that flat/unit, except those specifically required to be maintained by the Society under these Bye-laws.

(b) Without prejudice to clause (i), every Member shall be responsible for the maintenance, repair, renewal or replacement of the following:—

(i) internal plaster, flooring, tiles, marble, granite, wooden flooring, false ceiling, internal painting, wall finishes and decorative finishes;

(ii) internal doors, door frames, windows, ventilators, grills, glazing, glass panes, mosquito nets, locking devices and all other internal joinery;

(iii) internal electrical wiring, switches, sockets, distribution board, MCBs, RCCBs, electrical fixtures, fittings, appliances and all electrical installations beyond the Society's common supply point;

(iv) internal water pipelines, taps, valves, mixers, plumbing fittings, geyser connections and all plumbing installations beyond the Society's common supply line;

(v) internal drainage pipes, waste water pipes, sanitary connections and fittings serving exclusively that flat/unit;

(vi) wash basins, sinks, water closets, urinals, bathroom fittings, shower fittings, kitchen platforms, kitchen fittings, exhaust systems and all sanitary installations within the flat/unit;

(vii) internal waterproofing, tile joints, sealants, flooring treatment and finishing works carried out within the flat/unit;

(viii) balconies, flower beds, utility areas, attached terraces and other exclusive appurtenant areas, including their internal finishes and fixtures, except structural members and waterproofing specifically maintained by the Society;

(ix) air-conditioners, outdoor units, exhaust fans, solar water heaters, water purifiers, satellite dishes, internet equipment, EV charging equipment and any other equipment exclusively installed by the Member;

(x) all additions, alterations, fixtures, fittings and improvements carried out by the Member within the flat/unit;

(xi) all other fixtures, fittings, installations and appurtenances exclusively serving that flat/unit.

(c) Every Member shall promptly repair any defect or damage within the flat/unit which may cause leakage, seepage, blockage, vibration, fire hazard, nuisance, inconvenience or damage to the building, common areas, common services or any other flat/unit.

(d) No Member shall neglect repairs or maintenance for which he is responsible so as to endanger the structural stability, safety, sanitation, fire safety or serviceability of the building or to adversely affect any other Member or occupant.

(e) Where a Member fails to carry out repairs after reasonable notice and such failure is likely to endanger the building, common services or any other flat/unit, the Society may carry out such repairs and recover the actual cost incurred from the Member as dues of the Society, after giving the Member a reasonable opportunity of being heard, except in cases of emergency.

(f) Nothing contained in this Bye-law shall affect the responsibility of the Society for repairs and maintenance specifically assigned to it under these Bye-laws.
