Procedure for Expulsion of Member
(a) Expulsion shall be carried out strictly in accordance with section 35 of the Maharashtra Co-operative Societies Act, 1960 and Rules 28 and 29 of the Maharashtra Co-operative Societies Rules, 1961.
(b) No Member shall be expelled unless—
(i) a written show cause notice specifying the grounds is issued to the Member;
(ii) the Member is given not less than 15 days to submit his explanation;
(iii) the explanation, if any, is considered by the Committee;
(iv) the matter is placed before the General Body Meeting;
(v) the resolution is passed by the majority not less than 3/4th of the member present in the General Body Meeting called for the said expulsion proceedings and
(vi) the society has to submit the resolution for approval to the Registrar, and after hearing both the parties, the Registrar will pass order and that will be the final
(c) A Member shall cease to be a Member of the Society from the date on which the resolution of expulsion is approved by the Registering Authority.
