Q: What is the maximum interest rate on defaulted maintenance dues?

The Maharashtra Co-operative Societies (Amendment) Rules 2026 cap interest on defaulted maintenance charges at 12% simple interest per annum (Rule 106C-12). The rate must be fixed by a general body resolution — the managing committee cannot unilaterally set a higher rate.

(a) The name of the Society shall be "…………………………..…… " Co-operative Housing Society Ltd."

(b) No change in the name of the Society shall be valid unless it is approved by the General Body by the prescribed majority and registered by the Registrar in accordance with the provisions of Section 15 of the Maharashtra Co-operative Societies Act, 1960 read with Rule 14 of the Maharashtra Co-operative Societies Rules, 1961. After registration of such change, the Society shall intimate the same to all concerned statutory authorities, local bodies, banks, utility service providers and other institutions with which the Society has dealings.

(c) The Society is classified under the major class "Housing" and is registered as a Tenant Co-partnership Housing Society, as per its registration certificate issued by the Registrar under the Maharashtra Co-operative Societies Act, 1960. In a Tenant Co-partnership Housing Society, the land and building are owned by the Society, and the members hold shares in the Society along with a right of occupancy in the flats or units allotted to them.

(d) The Society shall ensure that its name, registration number and classification are correctly recorded and updated in all statutory records and communications.
