Redressal — Approach to Competent Authority

173. If the Member/Members are not satisfied by the decision of the Committee, or does not receive any communication from the committee within 15 days, the complainant Member may approach the following Competent Authority: (a) THE REGISTRAR - for matters such as: non-issuance of Share Certificates, Refusal of Membership, Non-registration of Nomination, Non-occupancy charges, Demand of excess premium, Non-supply of copies of records, Misappropriation of Funds, Non-conducting of elections, Non-convening of GBM on or before 30th September, and any other matters within jurisdiction of the Registrar. (b) CO-OPERATIVE COURT - for disputes under Section 91 of MCS Act 1960 including: resolutions of Managing Committee and General Body, elections of Managing Committee, Repairs and Leakages, Parking, Allotment of Flats, Excess recovery of dues, and any other disputes within jurisdiction of Co-operative Court. (c) CIVIL COURT - for disputes pertaining to: Non-compliance of Agreement terms by Builder, Substandard Constructions, Conveyance Deed, and any other disputes within jurisdiction of Civil Court. (d) MUNICIPAL CORPORATION/LOCAL AUTHORITY - for matters pertaining to: Unauthorized constructions, Inadequate Water supply, Change of use, Building structural problems, and other civil amenities. (e) POLICE - for matters pertaining to: Nuisance by Unauthorised user, Threatening or Assault by or to Members. (f) GENERAL BODY MEETING - for matters pertaining to: Non-maintenance of property by Managing Committee, Non-display of Society name board, Levy of excess Fine, Non-insuring the property, Appointment of Architect. (g) FEDERATION - DISTRICT/STATE - for matters pertaining to: Not allowing entry to Secretary, Non-acceptance of communication by Member/Managing Committee, Convening Special GBM and Managing Committee meetings as per Registrar directions.
