Q: What is the maximum interest rate on defaulted maintenance dues?

The Maharashtra Co-operative Societies (Amendment) Rules 2026 cap interest on defaulted maintenance charges at 12% simple interest per annum (Rule 106C-12). The rate must be fixed by a general body resolution — the managing committee cannot unilaterally set a higher rate.

(a) In consonance with Rule 106C-13(1)(a) of the Rules, the management and administration of the Society shall be governed by the Bye-laws of the Society as approved by the Registrar.

(b) Such Bye-laws shall constitute the fundamental governance framework of the Society, and all decisions, actions, and functions of the Society shall be carried out strictly in accordance therewith.
