Occupation and Use of Flat/Unit
Every Member shall occupy and use the flat/unit in accordance with the provisions of the Act, the Rules and these Bye-laws.
(a) A Member may occupy the flat/unit personally or permit its occupation by the members of his family, Joint Member, Associate Member, Provisional Member, tenant, licensee, caretaker or any other person lawfully entitled to occupy the flat/unit in accordance with the Act, the Rules and these Bye-laws.
(b) Every flat/unit shall be used only for the purpose permitted under the sanctioned building plans, the Occupancy Certificate, the conditions of lease or allotment, if any, and the applicable laws.
(c) No Member shall use or permit the use of the flat/unit for any purpose prohibited under law or in a manner likely to cause nuisance, annoyance, inconvenience, damage, hazard or danger to the Society or to any Member, resident or occupant.
(d) The Member shall be responsible for ensuring that every person occupying the flat/unit through or under him complies with the provisions of the Act, the Rules and these Bye-laws and shall remain responsible for any breach committed by such person.
(e) No Member shall part with possession of the flat/unit except in accordance with the provisions of the Act, the Rules and these Bye-laws.
(f) Nothing contained in this Bye-law shall prejudice the right of a Member to transfer, mortgage, exchange, sub-let, give the flat/unit on leave and licence or caretaker basis or otherwise deal with the flat/unit in accordance with the Act, the Rules and these Bye-laws.
